1. Scope of Application
1.1 These General Terms and Conditions (GTC) govern the contractual relationship between KAJA Living GesbR (hereinafter referred to as the "Host") and the renter (hereinafter referred to as the "Guest") for the rental of apartments & vacation homes via the website www.kajaliving.info and other platforms and channels.
1.2 The GTC apply to both private and business stay
2. Contract Conclusion
2.1 The contract between the Host and the Guest is concluded upon confirmation of the booking, which is sent either by email or through booking platforms.
2.2 By booking, the Guest agrees to these GTC.
3. Rental Period and Check-in/Check-out
3.1 Urban Luxury Apartments: No minimum rental period. Das Kranach 28: Winzerhaus minimum stay 3 nights, Stöckl minimum stay 2 nights.
Urban Serenity Apartment: Minimum rental period of 28 days.
3.2 Check-in is from 16:00 and check-out must be completed by 11:00. Any deviations must be agreed upon with the Host in advance.
3.3 In case of a late check-out without prior agreement, the Host reserves the right to charge an additional night.
4. Prices and Payment
4.1 The prices for the apartments & vacation homes are specified in the booking confirmation and include the statutory VAT. A tourist tax of €2.50 per person per night is also to be paid.
4.2 The total price is due upon booking.
4.3 Payments are to be made by bank transfer, credit card, or via the payment methods offered on the booking platform.
5. Cancellation
5.1 The Guest can cancel the booking free of charge up to 7 days before arrival. Cancellations made after this period will incur the full booking price (100%).
5.2 In case of a no-show, the full booking price will be charged.
5.3 The Host is entitled to withdraw from the contract for important reasons, especially in cases of force majeure or other unforeseen events, and when the Guest:
a) Uses the premises in a significantly detrimental manner or engages in reckless, offensive, or otherwise grossly improper behavior towards other guests, the property owner, their staff, or other persons in the accommodation, or commits a punishable act against property, morality, or physical safety;
b) Becomes infected with a contagious disease or a disease that persists beyond the accommodation period, or otherwise becomes in need of care;
c) Fails to pay invoices when due within a reasonable period (3 days).
6. Guest's Obligations
6.1 The Guest agrees to treat the apartment/vacation home and its furnishings with care.
6.2 Any damages occurring during the stay must be reported to the Host immediately. The Guest is liable for the full extent of any damages caused.
6.3 Smoking in the apartments/vacation homes is strictly prohibited. A cleaning fee of €500 will be charged for violations.
6.4 Pets are allowed upon request.
6.5 The Guest is liable for damages caused by improper use of facilities such as the sauna, whirlpool, or similar amenities. The Host is only liable for damages caused by violations of hygiene regulations or technical defects. The Guest is liable for damages caused by negligent use.
6.6 The Guest is responsible for compensating for damages to the property or building.
- 7. Liability
7.1 The Host is only liable for damages caused by intent or gross negligence.
7.2 The Host assumes no liability for the Guest’s valuables.
7.3 The Host is not liable for damages caused by improper use of facilities, particularly the sauna, whirlpool, or other wellness offerings, unless the damage results from violations of the Host's hygiene regulations.
8. Additional Conditions for Urban Serenity Apartment
8.1 This is a pure residential rental, and no intermediate cleaning will be provided.
8.2 The residential space must be returned in the same condition as it was at the start of the rental period.
8.3 The following cleaning requirements apply both for the handover and return of the property:
- Broom-clean
- Vacuuming, cleaning of kitchen, bathroom, and toilet, and disposal of waste.
8.4 The tenant explicitly confirms, by completing the booking, that the rented property will be used solely as a secondary residence.
8. Haftung
8.1 Der Gastgeber haftet nur für Schäden, die auf Vorsatz oder grobe Fahrlässigkeit zurückzuführen sind.
8.2 Für Wertgegenstände des Gastes übernimmt der Gastgeber keine Haftung.
8.3 Der Gast haftet für Schäden, die durch unsachgemäße Nutzung der Einrichtungen wie Sauna, Whirlpool oder ähnlichen Angeboten entstehen. Der Gastgeber haftet nur, wenn die Schäden durch Verstöße gegen Hygienebestimmungen des Hosts oder durch technische Mängel entstehen. Bei unachtsamer Nutzung durch den Gast haftet dieser.
8.4 Bei Beschädigungen an der Einrichtung oder dem Gebäude haftet der Gast und ist verpflichtet, den Schaden zu ersetzen.
9. Data Protection
9.1 The personal data provided by the Guest during the booking process will be processed in accordance with applicable data protection laws.
9.2 Data will only be shared with third parties to the extent necessary for contract fulfillment. Further details are available in the privacy policy..
10. Final Provisions
10.1 Any amendments or additions to this contract must be made in writing.
10.2 Should any provision of these GTC be invalid, the remainder of the contract shall remain valid. The invalid provision shall be replaced by a provision that comes closest to the economic purpose of the original provision.
10.3 Austrian law applies. The place of jurisdiction for all disputes arising from this contract is Graz.
